Right of Withdrawal

Right of withdrawal – Mediation Academy online - Mediations-Akademie.online

This version is a translation of the German withdrawal information. In the event of any discrepancy between the language versions, the German version shall prevail.

As a consumer, you have a statutory right of withdrawal under the Austrian Distance and Off-Premises Contracts Act (Fern- und Auswärtsgeschäfte-Gesetz, FAGG) in respect of each paid top-up of usage credit on the “Mediations Akademie online” platform. You may withdraw from the contract relating to the relevant credit top-up within fourteen days without giving any reason.

The withdrawal period is fourteen days. Since registration on the platform is free of charge and does not in itself constitute a transaction subject to the right of withdrawal, a separate period begins for each individual paid credit top-up. It begins on the day on which the contract for the relevant top-up is concluded, namely the date of the payment confirmation for that top-up. If you have topped up your credit more than once, each individual top-up has its own independent fourteen-day withdrawal period.

Exercising the right of withdrawal

To exercise your right of withdrawal, you must inform us at the following address:

of your decision to withdraw from the contract relating to the relevant credit top-up by means of an unambiguous statement, for example a letter sent by post or an email. You may use the model withdrawal form below, but this is not mandatory.

You may also exercise your right of withdrawal:

You will automatically receive an acknowledgement of receipt on a durable medium by email, stating the content of your declaration and the date and time at which it was received. To meet the withdrawal deadline, it is sufficient for you to send your notice concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you validly withdraw, we will reimburse the credit from the top-up concerned without undue delay and no later than fourteen days from the day on which we receive your notice of withdrawal. We will make the reimbursement using the same means of payment as you used for the original transaction, unless expressly agreed otherwise; you will not incur any fees as a result of the reimbursement. Your free access to your user account remains unaffected by the withdrawal. Only the credit top-up concerned will be reversed.

Early commencement of performance and proportionate payment

The service we provide – the AI-assisted provision of exercises and the evaluation of your answers – is supplied as soon as you use it, and the credit used for that purpose is consumed immediately.

For each credit top-up, we therefore separately obtain your express consent for us to begin performing the contract relating to that top-up before the withdrawal period has expired. We also obtain your acknowledgement that your right of withdrawal expires in respect of the portion of the credit that you have already used by the time you withdraw.

If you consented to early performance for the relevant top-up, the following applies:

If the credit from the relevant top-up has already been fully used at the time of withdrawal, your right of withdrawal in respect of that top-up has already expired.

If you have already used part of the topped-up credit at the time of withdrawal, only the remaining credit will be reimbursed.

We will reimburse this remaining amount as described above under “Effects of withdrawal”.

  • If you requested that performance begin during the withdrawal period, you must pay an amount proportionate to the services supplied up to the time of your withdrawal. If you did not consent to early performance for a particular top-up, you may exercise your right of withdrawal in full for that top-up during the fourteen-day period.
